Are you an employer looking to hire employees that require a work permit? Or perhaps you are someone who would like to know more about Swedish work permits and job-seeking visa applications? Whatever the case, we at Nimmersion have created a short guide to make things easier for you.
The Guide to Work Permits in Sweden
Recently, some firms have had to make the painful decision to reduce staff. The good news is that many talented employees quickly find new work opportunities. The talent shortage is marked and it can be valuable for Swedish companies to make use of this talent pool already in the country.
This presents significant opportunities for talent acquisition teams, HR, and project teams to meet prospective colleagues in person before starting work. It is often possible to hire a person already in Sweden on a permit, however, it is extremely important to ensure past and future compliance, for both the employer’s and the employee’s sake.
Key Considerations for Employers
For New Employers
- Check Work Permits: It is your legal responsibility to verify the current work permit status and ensure compliance with any employment changes. Nimmersion can assist with this process and provide historical context related to the individual.
- Work Permits in First 24 Months: Work permit holders in their first 24 months of employment in Sweden must apply for a new work permit if they find new employment or if there is a change of title or duties at their current employer.
- Changing Employers in Second Permit Period: During the second permit period (24-48 months), work permit holders can change employers with only a Tax Report of Foreign Hire if they have the exact same role. Any role change requires a new application. Note that the extension application after 24 months must be approved before an employee is considered in the second permit period.
- Permanent Residency Holders: These individuals are free to stay in Sweden and work for any employer they choose.
- Dependent Visa Holders: Employees on dependent visas may stay in the country as long as their permit is valid, i.e., the main applicant still has a valid permit in Sweden.
When Employees Leave
- Deregister Work Permits: Employers must deregister any pending or current work permits for individuals leaving or who have already left the company.
- Maintain Compliance: Continue to pay salaries throughout the notification period and keep all insurances up to date.
- Provide Documentation: Offer a complete packet of certificates of insurance coverage, employment certification stating dates and title, and a reference for the next employer to review.
What Employees Can Do
- Job Seeking After Employment Ends: Work permit holders with permits valid for longer than six months can stay in Sweden for 90 days after their last day of employment to look for new job opportunities. It is important to note that their permit must remain valid to stay in the country.
- Job Seeking Visa: There is a Job Seeking visa available for those who need more time to search for jobs. You can read more about the application here.
